Refunds and Cancellations

Terms & Conditions, Cancellation and Refund Policies for Dianna Toh Resources

Force Majeure: In the case of a national emergency, an Act of God, terrorism, a natural disaster, training venue issues (renovations or closing or similar), changes required to accommodate the majority needs of students, sudden and unavoidable changes to travel, sudden and unavoidable changes to technology, sudden incapacity of trainer(s), then trainings dates, times or locations may be changed by Diana Toh Resources and students will be advised of the change noting that delays may occur which are outside of the hands of the company. In this case, no refund will be due. The credit may be transferred to another training or used to purchase product(s).

REFUNDS and CANCELLATION

• On your enrolment  agreement which you signed, there are some points about cancellation –  they are part of this cancellation policy. When you enrolled for this  training and coaching, you had available coaching support from a  coach/trainer (whether you have chosen to use it or not). The refund policy is based on that support as well as the training materials you received when you enrolled (if any).
• You have  acknowledged on the enrolment agreement that the non-refundable  cancellation fee may only be applied to a future training with Dianna Toh  Resources for two (2) years from the date of the enrolment agreement. You  can choose to extend this by paying the current rollover fee.
• If you decide not  to attend the training you have initially enrolled into, as long as we are  informed two (2) months or more before the commencement of the training, you      can choose other training or coaching offered that is of the same price.      Any differential amount will not be refunded.
• If you have placed an amount toward a training you have enrolled into, and that amount is less than or is the same amount as the deposit, then no refund will be  given, regardless of when your cancellation is lodged.
  • If you have entered into an agreed payment plan and received a discount on the price of the       training, you are liable for and responsible for ensuring you’re your payments are completed by the due date specified in the Enrolment  Agreement. Failure to do so will result in you being required to pay the full price for the training and/or pay a penalty. Failure to respond to repeated attempts to contact you for updated payment information may       result in your account being sent to a Debt Collection agency.
• If you cancel  your enrolment within or less than two (2) months of the start of the training that you have initially enrolled into, then no refund will be      given, and your complete payment will be brought forward to the next      training of your choice (within maximum 2 years or less from the date of the first payment. You may also decide to purchase product(s), training, or coaching up to the value of the amount paid, less the amount of the  deposit and a RM2,000 cancellation fee. 
• If you don’t show  up at the training or abandon the training at any point during the  training, no refund is due. The cancellation fee is in this case 100% of  the amount paid. If you fail to attend a specific training without      notifying us then there will be no refund due to you, although at the discretion of Dianna Toh Resources Management you may be able to select another training if it is within the 2-year period as specified above.
• If, during the training you are found unfit to participate in that specific training (deemed by staff, representative of the company and or students to be disruptive, disrespectful, bullying, non-participative, harassing) you will be required to leave the training immediately. No questions or discussions will be entered into, and Dianna Toh Resources representatives and/or staff will be the sole judge. In this case, no refunds will be given. All training materials including manuals are to be returned  immediately. In the case of online or hybrid training, you agree that you will discard and deleted (all copies on all media) the training material.

• In case you cannot attend (for whatever reasons) a face-to-face training in company-specified  location you agree that attending the training online would be acceptable      and would be a suitable replacement. All associated costs arising from this choice would then be your responsibility.

We cannot guarantee all actual products will be the same as we innovate the trainings and coaching as we progress.

User shall agree that Diannatoh.com may send newsletter regarding the latest news/products/promotions etc through email to the user.

Indemnification

The user shall agree to defend, indemnify, and hold Diannatoh.com harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site.

Link to other sites

Any access link to third party sites is at your own Diannatoh.com will not be related or involve to any such website if the user's content/product(s) got damaged or loss have any connection with third party site.

Inaccuracy Information

From time to time, there may be information on Diannatoh.com that contains typographical error, inaccuracies, omissions, that may relate to product description, pricing, availability, and article contents. We reserve the rights to correct any errors, inaccuracies, change or edit information without prior notice to the customers. If you are not satisfied with your purchased product(s), please return it back to us with the invoice. 

Termination

This agreement is effective unless and until either by the customer or Diannatoh.com. Customer may terminate this agreement at any time. However, Diannatoh.com may also terminate the agreement with the customer without any prior notice and will be denying the access of the customer who is unable to comply the terms and conditions above.

Payments

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa, MasterCard or online payment methods.

Payments cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of Your Order.
